It is an initial appraisal of your situation. It will help you decide whether the regulation applies to your workplace and whether you require the written assessment covered in Section III. If you decide that the assessment is required, be sure to include your Section II worksheets in the final report. Refer to the Designated Substances Regulation 490 for details on what applies to the chemical being assessed. There are three key questions to be answered in determining whether the Designated Substances Regulation applies to your workplace: 1. Is the substance present at the workplace? This means considering whether the substance is present, produced, used, processed, handled, stored or is a waste product or by product of a process in the workplace or during transportation. 2. Is any worker likely to be exposed to the substance? A worker may be exposed through inhalation, ingestion, absorption through the skin. If the substance is present all of these possibilities must be considered. 3. Do any of the exemptions in the application section apply to your workplace? Certain workplaces are exempt from following Regulation 490/09, and these details can be found in sections 3-14. Note: The amount of information you will need to collect will vary according to the nature of your work. In some operations, the presence of a designated substance will be obvious while in others its presence may be obscured. Proceed to the guidelines in Section V on how to approach these questions.
